Product:
Bio-diesel for use in motor transport meeting the MSA EN 14214 specifications as shown in Appendix A. This bio-diesel is to meet the sustainability criteria as defined in Directive 2009/28/EC.
Quantity:
Option (i)
A maximum quantity of one million, five hundred and thirty thousand (1 530 000) liters at Buyer’s option divided into six batches of maximum 255,000 liters each, of bio-diesel not produced from waste and residues, other than agricultural, aquaculture, fisheries and forestry residues;
OR
Option (ii)
A maximum quantity of seven hundred and sixty five thousand (765,000) liters at Buyer’s option divided into six batches of maximum 127,500 liters each, of bio-diesel produced from waste and residues, other than agricultural, aquaculture, fisheries and forestry residues.
Duration of Contract:
Due to developments in the commercialization process of the Petroleum Division (the entity responsible for the storage and distribution of diesel in Malta), buyer reserves the right to terminate the contract by giving one month’s notice, without any obligation to take up any undelivered cargoes and without any penalty.
Documentation:
The following documents shall be made available to the buyer according to the option chosen from above:
Option (i)
1. Quality certificate of bio-diesel;
2. In the case of the fuel being of EU origin and an Original Certificate of Origin is not available, the EU customs document INF3 is to be supplied.
3. Certificate verifying the nature of the raw material from which the bio-diesel was produced.
4. Certificate verifying that bio-diesel was not produced from raw material obtained from land with high biodiversity value as defined in Article 17, Paragraph 3 of EU Directive 2009/28/EC.
5. Certificate verifying that bio-diesel was not produced from raw material obtained from land with high carbon stock as defined in Article 17, Paragraph 4 of EU Directive 2009/28/EC.
6. Certificate verifying that bio-diesel was not produced from raw material obtained from land that was peatland in January 2008, unless evidence is provided that cultivation and harvesting of that raw material does not involve drainage of previously undrained soil.
7. Certificate verifying that agricultural raw materials cultivated in the EU Community and used as raw material for the production of the bio-diesel supplied, shall be obtained in accordance with the requirements and standards under the provisions referred to under the heading ‘Environment’ in part A and in point 9 of Annex II to Council Regulation (EC) No 73/2009 of 19 January 2009, and in accordance with the minimum requirements for good agricultural and environmental condition pursuant to Article 6(1) of that Regulation.
Option (ii)
1. Quality certificate of bio-diesel;
2. In the case of the fuel being of EU origin and an Original Certificate of Origin is not available, the EU customs document INF3 is to be supplied.
3. Certificate verifying that fuel supplied was produced from waste and residues, other than agricultural, aquaculture, fisheries and forestry residues.
